Electronic Disclosure Consent Agreement

General

This Bank of Bourbonnais (“Bank”) Electronic Disclosure Consent Agreement (“E-Sign Consent”) applies to all communications for deposit and loan account products and services offered online or through digital applications by the Bank. You should read this entire document carefully before consenting to the E-Sign Consent as part of the online application process. By accessing this document, you are demonstrating your ability to access electronic communications in this format prior to consenting to this E-Sign Consent. You must agree to this E-Sign Consent to use the online or digital applications for Bank products and services.

Definitions

The terms “we”, “us” and “Bank” refer to Bank of Bourbonnais or any affiliate, agent, independent contractor, or designee that we may use to provide Bank products or services. The terms “you” and “your” refer to the user of Bank of Bourbonnais’ online accounts and services, whether singular or plural, who: (1) is an individual that is the owner of an account at the Bank, or (2) is an individual authorized by an account owner or to view account information or effect transactions on an account. The term “Communications” means any and all communications from the Bank to you, including, but not limited to, any customer agreements, including any amendments; disclosures; notices; responses; transaction histories; Privacy Policies; and any and all other information related to Bank products and services, including any information that we are required by law to provide to you in writing.

Scope of Communications to be provided in Electronic Form

When you apply for a Bank account and/or enroll in services online or via a digital application, you agree that we may provide you with all Communications in electronic form and that we will discontinue sending paper Communications to you, unless you withdraw your consent as provided in this E-Sign Consent. Your consent to receive electronic Communications includes, but is not limited to, consent to receive the following electronically:

  • All legal and regulatory disclosures and Communications associated with Bank products and services available online or through digital applications.
  • Notices or disclosures about a change in the terms of your account.
  • Our responses to your requests relate to your accounts and services at the Bank.
  • Privacy Policies.

This consent to receive Communications electronically does not enroll you in:

  • Online Banking
  • Mobile Banking
  • Online Statements
  • Notices
  • Tax Documents
  • Alerts
  • Any service that provides your Bank deposit or loan account documents electronically.

If you would like to use Bank of Bourbonnais’ Online Banking Services, please enroll directly through the link on our website at https://b071924160.flex.online-banking-services.com/cuFlexEnrollment/#!/selfEnrollment/home/.  If you would like to receive your deposit or loan communications electronically and no longer receive paper communications, please use Bank of Bourbonnais’ Online Banking Services or the Mobile Application to sign up for our Online Statement service.

Method of Providing Communications to You in Electronic Form

You must provide us with a current e-mail address to receive electronic Communications. All Communications that we provide to you in electronic form will be sent to your e-mail address on record.

Delivery of Online Statements

In order to receive your statements online, you must be enrolled in Bank of Bourbonnais Online Banking. Once enrolled in Online Banking and Online Statements, you will no longer receive paper statements.

You will receive an email when your statement is available for viewing. To view the online statement, log into Bank of Bourbonnais’ Online Banking. The available online statements will be displayed under the Accounts / Documents / Statements link on the top navigation panel or via the mobile application by clicking on More at the bottom of the app, Statements and Documents, Statements, select the Account and select the statement to view. The online statements for your account(s) will be available online for 7 years. The 7 years will start from the date of enrollment. The statements will be in a portable document file (PDF). Adobe Acrobat Reader is required for Online Statements and can be downloaded free of charge at https://get.adobe.com/reader/.

To retain a copy of the statements, disclosures, agreements and required notices, you will need a media storage device (e.g., hard drive) and/or a printer to print copies of the documents. You also have a right to obtain paper copies of your current and prior account statement(s) and required notices by contacting Customer Service by phone at 815-933-0570. We will charge the Bank Statement Reproduction fees as set forth in the Bank’s current Consumer Service Charge Schedule which may be amended by the Bank at any time.

Online Banking is generally available 24 hours a day, seven days a week; however, service may be unavailable from time to time for routine software and hardware maintenance or due to unscheduled down time.

How to Withdraw Consent

You may withdraw your consent to receive Communications in electronic form by contacting us at Bank of Bourbonnais, One Heritage Plaza, Bourbonnais, IL 60914 Attention: Customer Service. You may discontinue the online statement service, notices and/or tax forms by logging onto Online Banking and changing your selection by clicking on the Accounts / Documents / Delivery Settings tab on the top navigation panel and selecting the tab for Statements and Notices or Tax Forms and selecting Paper next to each account that you would like to change. To complete the request, click on View Electronic Consent. After reviewing, click the Close tab on last page and then click on “I have read and agree to the terms of the Agreement” and click Submit. By changing an account's statement delivery method from Online to Paper, you will lose access to any statements previously delivered online. You may want to save your online statements before making this change. Bank of Bourbonnais’ may suspend or terminate your Online Statement service at any time without notice. You may be charged a paper statement fee if you choose to terminate your enrollment in Online Statements. Please see your deposit account agreement and consumer service charge schedule for applicable fees. Termination of your enrollment in the Online Statements service will not affect your enrollment in the Bank of Bourbonnais’ Online Banking service.

You may discontinue the Online Statement service via the Mobile Banking app by clicking More, under Account Management, click Statements and Documents, click Delivery Preferences, and selecting Paper next to each account that you would like to change. To complete the request, click on View Electronic Consent. After reviewing, click the Close tab on last page and then click on “I have read and agree to the terms of the Agreement” and click Submit. By changing an account's statement delivery method from Online to Paper, you will lose access to any statements previously delivered online. You may want to save your online statements before making this change. Bank of Bourbonnais’ may suspend or terminate your Online Statement service at any time without notice. You may be charged a paper statement fee if you choose to terminate your enrollment in Online Statements. Please see your deposit account agreement and consumer service charge schedule for applicable fees. Termination of your enrollment in the Online Statements service will not affect your enrollment in the Bank of Bourbonnais’ Online Banking service.

How to Update Your Records

It is your responsibility to provide us with your accurate e-mail address, contact information, and other information related to this E-Sign Consent and your Account(s) and to maintain and update promptly any changes to this information. You can update your information through Bank of Bourbonnais’ Online Banking Services by clicking on Self Service, then Self Administration in the top navigation panel, or by contacting us at:

To help protect the confidentiality of your personal information, please do not send us any confidential information via unencrypted email messages.

Hardware and Software Requirements

In order to access, view, and retain electronic Communications that we make available to you, you must have:

  • Access to a device (e.g., computer, smartphone, mobile device, tablet, etc.) suitable for connecting to the Internet, or downloading our mobile apps with the Current Version (as defined below) of (i) an operating system, such as Windows, Mac OS, iOS, or Android, that we support; and (ii) a web browser, such as Internet Explorer, Chrome, Safari, or Firefox, that we support.
  • A connection to the Internet;
  • Local electronic storage capacity to retain Communications and/or a printer to print them;
  • A valid e-mail account and software to access it; and
  • Software that enables you to view and display files in HTML and PDF format.

By “Current Version”, we mean a version of the software that is currently being supported by its publisher. From time to time, we may offer services or features that require that your Internet browser be configured in a particular way, such as permitting the use of JavaScript or cookies. If we detect that your Internet browser is not properly configured, we may provide you with a notice and advice on how to update your configuration. We reserve the right to discontinue support of a Current Version of software or an operating system if, in our sole opinion, it suffers from a security flaw or other flaw that makes it unsuitable for use.

If our hardware or software requirements change, and that change would create a material risk that you would not be able to access or retain electronic Communications, we will give you notice of the revised hardware or software requirements. Continuing to use this service after receiving notice of the change is reaffirmation of your consent.

Requesting Paper Copies

The Bank may charge you a reasonable service charge, of which we have provided you with notice, for the delivery of paper copies of any Communication that you request.

We reserve the right to provide a paper (instead of electronic) copy of any Communication that you have authorized us to provide electronically.

Joint Account

If any accounts are joint accounts, you acknowledge that you are the authorized accountholder of the joint account and that your consent and authorization has been authorized by each of the joint accountholders. All joint accountholders on the account are legally bound by the terms and conditions of this Consent and Authorization.

Communications in Writing

All Communications in either electronic or paper format from us to you will be considered “in writing”. You should print or download a copy of this E-Sign Consent and any other Communication that you wish to keep for your records.

Change in Terms

You understand that the Bank may change this Agreement at any time. Changes to this Agreement will be effective immediately after the Bank makes them, unless applicable law requires the Bank to provide advance notification. Those changes will be effective immediately after advance notice has been issued or upon the date stated in such notice, as required by applicable law. If the changes would result in any increased fees or liability, the Bank agrees to provide notice at least thirty (30) days prior to the effective date.

Security Measures

The Bank will use reasonable measures, consistent with industry standards, to maintain an appropriate level of security over the information contained in your Online Statement. The Bank has no control over the people who have access to your personal computer and Online Statements once they are in your possession. The Bank will not be liable for any unauthorized access to your personal computer or to the information maintained on your computer, including Online Statements. You are responsible to initiate and maintain adequate procedures to prevent unauthorized access to your personal computer or unauthorized use of your electronic or other files, including your Online Statement. The industry standards for electronic technology are constantly changing, and new standards are being developed. You acknowledge by consenting to this Authorization that there are risks to the electronic delivery of your Online Statements, including but not limited to: 1) delay or failure due to technical difficulties, 2) weather conditions, 3) matters beyond the Bank’s reasonable control, 4) alteration of bank statements by third parties in spite of the Bank’s reasonable security measures. By consenting to this Agreement, you represent to the Bank that you have considered the Bank’s security measures and find these security measures to be reasonable. You should consider the content of your Online Statements, the risks associated with the electronic delivery of your Online Statements, and the Bank’s security procedures.

Federal Law

You agree that your consent to electronic Communications is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act).

Termination and Amendments

We reserve the right, in our sole discretion, to discontinue the provision of Communications in electronic form, or to terminate or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any termination or change as required by law.

Consent

By selecting the box next to “I/we read and agree to the Bank of Bourbonnais’ Electronic Disclosure Consent Agreement”, you are consenting to having electronic Communications provided to you as described in this E-Sign Consent. You agree that you and your computer or mobile device satisfies the hardware and software requirements specified in this E-Sign Consent, that you have provided us with a current e-mail address, and that you were able to view, download, and print this E-Sign Consent.
